浅议罚金刑的利弊

长期以来,我国刑法学界关于罚金刑的讨论一直没有间断,其占主导地位的观点是发展完善罚金刑,与此同时,立法界也越来越重视罚金刑的适用。但众所周知的是,在司法实践中罚金刑的适用率相比较于立法来说仍然是很低的,并且存在一系列需要解决的问题。为此,本文拟从罚金刑的利弊及其完善等方面进行说明。

Study on Advantances and Disadvantances of Fine

For a long time,the scholars studying criminal law in China never stop the discussion about the law of Fine.The vitally important view is to develop the money penalty and make it more reasonable.At the same time,the scholars studying at the legislation pay more attention to how to put it into practice.It is well known that Fine in practice is not often put into use.And it is urgent to solve so many problems about that.So the author will demonstrate the advantages and shortcomings of Fine,and give some advice how to modify it in this paper.
