| 摘 要： | 由于青少年犯罪率的逐年上升和恶性案件的频发，法律界出现了降低刑事责任年龄的呼声。但刑罚功能不仅仅是法律问题，也涉及到社会对刑罚价值的期望和刑罚功能的认同。对犯罪尤其是未成年犯罪的控制是一项综合社会工程，刑罚并不是唯一手段。
