| 摘 要： | 我国刑法269条规定的转化型抢劫罪在司法适用中存在诸多的争议,对法条的不同理解导致了在定罪量刑上的巨大差异。本文从转化型抢劫罪的适用条件与转化型抢劫罪的犯罪形态两个方面进行了探讨,进一步论证了转化型抢劫罪适用的前提条件、客观条件和主观条件与转化型抢劫罪的既遂与未遂的犯罪形态问题。

| Abstract: | There are great disputes on applicability of transformed robbery in article 269 of Chinese Criminal Law,on which the different understanding leads to different sentence on the conviction and the measure of penalty.This paper discusses applicable conditions and criminal pattern of the transformed robbery,further proving the prerequisite,objective conditions,subjective conditions of the transformed robbery and criminal pattern of attempted and accomplished transformed robbery. |
