被告人口供的证明力问题研究

被告人口供是法律规定的一种证据形式,实践中对案件事实具有极强的证明力。我国司法机关通过司法解释的形式完善了对刑讯逼供等非法手段获取口供的排除规则。然而,目前的非法口供排除规则仅能从形式上排除非法口供,非法口供实质上已经通过庭前案卷移送预先进入审判者的视线,并最终对案件事实的认定发挥重要作用。因此有必要对口供的证明力进行研究,分析口供证明力的发生机制,提出阻断非法口供证明力的具体建议。
