| Abstract: | China has revised the law of marriage in 2001, among them has raised the great disturbance in the whole country about the content of " prerequisite of divorce". The new marriage law has already generally been applicable for 4 years in the whole China even to this day, but in line with the rigorous academic attitude, the author is originally still querying to some clauses and legislative thoughts in the Amendment. Having analyzed this question in an all-round way in terms of theory, history, the author puts forward a comparatively novel view to the legislation of the marriage law. |
