Based on comprehensive analysis of the right of claim for dividing co-ownership by shares, this thesis studies relevant theoretic issues and practice issues of the right in detail. These issues include the nature of the right of claim for dividing co-ownership, the nature of dividing agreement, interaction between dividing agreement and dividing by litigation, the relationship between the right of claim and statute of limitation under the dividing agreement, the auction and selling of dividing methods adopted in dividing litigation, exercising the right of claim for dividing co-ownership by subrogation, restriction on the right by movable property and restrictive registrations, the legal consequence of excising the right, namely bringing it into effect, establishing the system of the right to mortgage in legislation, and the legal consequence of excising the usufructuary right or the real right for security and so on.
