成熟的市民社会－宪政与法治的基石

本文认为 :市民社会和民主宪政与法治精神紧密相联。市民社会培育了宪政文化 ,蕴育了法治精神 ,形成了社会权力 ,消解了国家压力。因此 ,宪政与法治的实现离不开市民社会的培育和成熟。作者指出 ,中国历史上市民社会的缺失和现实中市民社会的不成熟是中国难以实现宪政与法治的根本症结。因此 ,中国建立宪政之途和走向法治之路就是培育和形成成熟的市民社会。为了加快中国市民社会的成熟 ,以为宪政与法治铺垫基石 ,文章强调 :应进一步推进经济的市场化、加强政治民主化和权力监督、推动社会利益分散化和利益多元化以及推动思想意识和文化的多样化。

The Mature Civil Society--Foundation for Constitutional Government and Ruling with Law

The civil society has close connection with democratic constitutional government and spirit of ruling with law. By cultivating the culture of constitutional government and accumulating the spirit of ruling with law, the civil society shapes the social authority and clears up the pressure on the state. The reason why can the constitutional government and ruling with law be realized in China is the historical lack and realistic immaturity of civil society. We should promote the growing of civil society in China to pave a road for the constitutional government and ruling with law, to boost the market economy, to strengthen the political democracy and authority supervision, to advance the distraction and multiplicity of social benefits and accelerate the multiplicity of thoughts and culture.
