| 摘 要： | 法律行为曾被称为"大陆法系民法学中最辉煌的成就"。意思表示乃法律行为的核心。但意思表示除了健全的意思表示外,还有瑕疵的意思表示。它直接关系到法律行为的效力。大陆法系特别是德国对此有比较系统的规定,但是我国在意思表示瑕疵制度的构建方面无论是理论还是立法都比较散乱,缺失。所以在中国民法典呼之欲出的时候,再论中国意思表示瑕疵制度构建以及立法思量就愈加重要。 |

| Abstract: | The theory of legal act has been asked as the most brilliant achievement in civil law.The expression is the core of legal act.But apart from sound expression,the expression with slight defects is very important.And the expression with slight defects has a direct impact on the effectiveness of legal acts.The civil law,especially the German law,has quite a system requirements for the theory of the expression with slight defects.No matter the theory or the legislation,the legislative construction about the theory of the expression with slight defects in China is scattered and missing.When the Chinese civil code is coming,the discussion about Legislative Construction of the expression with slight defects is increasingly important. |
