The Name of Contract, the Real Administration

Government's procurement contract outwardly refers to civil contract but inwardly implies the administrative essence. In such contract, the client of administrative organ or administrative organ is one party of government's procurement contract; the application of the principle of intention expression is limited; non-appointed right exists in the contract; and the modification or lapse of the contract is limited. Therefore, in order to solve the dispute of government procurement contract, it's expected to adopt an integrated method which can combine civil relief with the administration relief together.
