农村集体土地所有权的流转问题探讨

现实生活中,农村集体土地所有权的流转并不少见。然而,除土地征收外,其它形式的流转并未得到立法的肯认。通过对农村集体土地所有权流转的必要性、形式、原则、程序以及土地征收、征购等问题的探讨,认为未来的物权立法应正视现实,对农村集体土地所有权的流转予以规定。

Inquiries on the Sales of Rural Collective Land Ownership

It is very frequent that the lands collectively owned in rural areas are sold.However,the forms of sales of such land are not legally admitted expect expropriation.Through the study of the necessity,form,principle,procedure and expropriation and acquisition of land,it can be seen that the legislation on real property should face the reality,and regulate the sales of lands collectively owned in rural areas.
