| 摘 要： | “诱惑侦查”或称“警察圈套” ,是一个行之有效的侦查手段。但是 ,我国法律、法规或司法解释都未对此作出规定 ,实践中经常对被诱惑者的罪责问题产生争议。本文根据罪责自负和罪刑相当的原则探讨了因诱惑侦查参加犯罪的被诱惑者的罪责问题。

| Abstract: | Lure investigation" or "police trap" is an effective investigating method. But, there is no explanation on it in our laws and rules, which often leads to confusion and argument on the culpability of the lured in the practice. In this paper, according to the principles of being responsible for one's own responsibility and punishment corresponding to crime, the author discusses the culpability of the lured in the lure investigation. |
