| 摘 要： | 现代程序价值观的演进中实际暗含了经济法的社会利益为本位的法律精神 ,这是中国经济程序法存在之可能性及其必要性的客观反映。同时 ,经济程序法本身也可以为中国经济法的存在和成长提供外在支持 ,这是由现代程序法本身的价值功能目标所决定的。中国经济法完全可以通过程序理性而使得自身的法精神得以体现。

| Abstract: | The spirit of economic law has been hinted in the evolvement of the value view of modern judicial procedure; this is the objective performance of the possibility and the necessity of Chinese economic law. And meanwhile, the judicial procedure of economic law can provide the support for the existence and the development for itself. Our economic law can embody its spirit by the logic of procedure also. |
