| 摘 要： | 由于历史背景、立法精神和逻辑起点等不同,《经济、社会和文化权利国际公约》和《公民权利和政治权利国际公约》,这两个国际人权公约与我国宪法存在差异。我国人权宪政机制的整合需要完善国内宪法,发挥解释机制的作用;签署或批准公约时声明保留;正确处理我国宪法与两个国际人权公约的效力问题;人权原则的制度化和法律化等。

| Abstract: | Owing to the historical background,legislative spirit and logical starting point,differences exist among 'the International Conviction of economic, social and cultural rights' and 'the International Conviction of Citizen Rights and Political Rights' and our country's constitution.The integration of our country's system of human rights needs perfecting domestic constitution,giving free rein to the function of the interpreting mechanism,stating reservation while signing or approving convictions,properly dealing with the effect problems of constitution and the two international convictions;setting up a systematic and legal procedure of principles of human rights. |
