论特权合理性之要件

天理,即自然法。以是否符合天理为标准,特权有合理与不合理之分。符合天理者为合理之特权,违反天理者为不合理之特权。特权的合理性要件有:特权不应违背善良风俗,特权宜顺应经济基础与政治发展的要求,特权宜源自公正的社会分层,特权所占用的社会资源要合理适度。
