合同纠纷中诉讼主体的追加问题研究

在诉讼中存在三种追加诉讼主体的情形,其中原被告都有权要求追加诉讼主体,但是追加诉讼主体是有一些条件限制的,即该追加主体必须符合诉讼主体的资格要求。笔者以案释法,说明理顺上下级法院之间的监督关系,严格依法办案是正确解决司法实践中合同纠纷案件诉讼主体追加问题的关键,也有助于我国法治体制的建构。
