| 摘 要： | 产生刑讯逼供的根本原因是讯问的合法性、口供的重要性,以及侦查中追求口供的态度;其直接原因是“如实供述”的义务和侦查人员的自由裁量权;现实原因是缺乏“非法证据排除规则”和对侦查讯问的有效监督。

| Abstract: | The fundamental reason to extort a confession by torture is the legitimacy of interrogation, the importance of oral confession and the attitude to pursue oral confession in the detection;its direct reason is the obligation to"confess according to the actual facts"and the free judgment power of the detectorjthe realistic reason is lack of"the rule to exclude the illegal proof'and the effective supervision over the detector. |
