| 摘 要： | 三大法系犯罪构成体系的具体构成因素基本相同，区别主要在于其内在结构的差异。我国犯罪构成体系是从追究犯罪的角度设计的，是一个“单边主义”的结构模式。大陆法系“递进式”犯罪构成体系内部虽存在二元结构的对立，但这种二元结构没有贯彻到底，是一种“瘸位”的结构模式。英美法系“平位”的结构模式有利于程序正义与结果正义的统一。

| Abstract: | The component of tatbestand system in "three geneology of law" is similar,while their structures differ greatly.The tatbestand system of China is a "unilateralism" model designed in punishment.The tatbestand system of Germany and Japan is a "lameness" model in which there is a discontinuity binary model.The tatbestand system of America is a "prosposition" model which is beneficial to the procedural and sequent justice. |
