论身份情谊行为

婚姻家庭法较其他民法规范更具身份法属性,基于其浓厚的伦理感情底色,在没有足够充分且正当理由的情况下,应将婚姻家庭领域的身份行为特别是身份协议推定为情谊行为。身份情谊行为可分为以人身权益为主的身份情谊行为和以财产权益为主的身份情谊行为,当前婚姻家庭法学理论对身份情谊行为的惯性思维判断是认定相关身份协议违反善良风俗原则而无效,这不是妥当的价值判断结论,仍属于法律中心主义特别是财产法中心主义的产物。

Gefalligkeits Based on Status

The marriage and family law has more intrinsic characters of status law than other civil laws . Due to the dense ethic and affection grounding , the status conducts , particularly the status agreement should be deemed as Gefalligkeit in absence of sufficient and justified reasons .Gefalligkeits based on status can be divided into conducts principally based on personal rights and interests and conducts principally based on prop -erty rights and interests .In accordance with conventional theories , status agreements shall be determined as void for breach of the doctrine of boni mores .However , such conclusion is improper value judgment for it is based on the centrism of law and centrism of the property law in particular .
