| 摘 要： | 未成年犯缓刑是针对犯罪未成年人进行特殊保护的刑罚制度,其符合"教育为主、惩罚为辅"的未成年人犯罪的刑事政策,有利于预防和减少未成年人犯罪。未成年人缓刑的理论基础包括刑罚个别化、刑罚谦抑性和教育刑等原则,应当在上述理论的指导下对未成年犯缓刑制度予以完善。
