中国当前法律冲突的解决机制--以公民基本权利保障为视角

由于我国立法主体的多层次性，立法数量的庞大，法律冲突不可避免，这势必会影响到公民宪法基本权利的保障。由于法律冲突的存在，即调整同一社会关系或解决同一问题的不同位阶的法律规定内容不同，就势必会侵犯公民的基本权利。因此，只有有效的解决中国当前的法律冲突，才能有效的保障公民的基本权利，这已经成为当今中国面临的重要法律问题。文章试从立法过程、执法过程、司法过程和公民个人的违宪审查建议权这几个方面，阐述如何更好地解决中国当前的法律冲突的路径，从而进一步保障我国公民的基本权利。

The Settlement Mechanism of Legislative Conflict in Current China ---View from the Fundamental Rights of Citizens

Due to multilevel legislative bodies in current China, and a large number of legislation, the legislative conflict is unavoidable. This would undoubtedly affect the protection of citizens＇ fundamental rights in China. As a result of the legislative conflict, that is to say, there are different legal provisions in different level legislations in adjusting the same social relation or resolving the same legal question, it inevitably infringes upon citizens＇ fundamental rights. Therefore, China＇s current legislative conflicts should have been effectively solved first, which could effectively guarantee citizens＇ fundamental rights. This has become an important legal issue facing China today. The author tries to find out the better way to solve the current legal conflict from legislation, law enforcement, the judicial process and citizens＇ suggestions rights for unconstitutional review in China, to further guarantee the citizens＇ fundamental rights in our country.
