| 摘 要： | 合同是一种在法律主体之间发生特定的权利义务关系的法律行为。债是一种在法律主体之间存在特定的权利义务的法律关系。合同与合同之债的关系 ,在形而上层面是法律行为和法律关系的关系。法律的构成要件和效果 ,是规范上的模态关系 ,法律行为和法律关系 ,均为一定的法律价值判断 ,因而在一般语境中 ,合同与合同之债是同义语。

| Abstract: | A contract produces particular rights and responsibilities between certain legal parties.It's a kind of legal action,which conforms to the legal requirement.Obligation means a kind of legal relation of certain rights and responsibilities among legal bodies.The relation of contract and contractual obligation is the relation of legal action and relation in essence,while the latter is similar to that of social action and social relation. |
