| Abstract: | The right of portrait is the civil right enjoyed by the citizen. Constituting the infringement upon the right of portrait should comply with the following three elements: (a) the conduct of using the portrait; (b) without the permission of the owner of the portrait; (c) without the reasons of stopping from infringement. The infringement by using the collective portrait should be considered intentional, needing treating in a different way so as to be determined. |
