| 摘 要： | 占有保护是占有制度的关键和核心。《物权法(草案)征求意见稿》将占有单列一编,但关于占有保护的规定仅有一条,且对于占有人的私力救济权、妨害危险防止权、共同占有人之间的保护等都未作规定。本文从分析我国对占有的认识、立法现状、占有制度的目的、功能入手,论证了我国建立占有制度保护占有的必要性,并对现阶段的《物权法(草案)征求意见稿》进行了比较分析,进而提出了自己的立法建议。

| Abstract: | The key part of the occupancy system is occupancy protection. It is one of the parts in A Draft of Appealing For Opinions On Real Law, but merely with one rule. It prescribes no regulations in this part for the private almsgiving right, the preventing right of encumbering danger, the protection of the common owners, etc. This paper, through an analysis the understanding of occupancy, the situations of legislation, the aims and functions of the occupancy system, demonstrates the necessity of constituting the occupancy system, and based upon this analysis, compared with the current A Draft of Appealing For Opinions On Real Law, proposes own suggestion of legislation on this aspect. |
