"小产权房"问题的出现,显示出现行土地制度的缺陷,使之在理论和实践中都面临着巨大的困境并影响其存在的正当性和合理性。由此应该以现行土地制度为基础,通过逐步缩小可转让的限制,并使宅基地使用权真正权利化,从而真正找到一条适合中国农民和农村经济发展的道路。

The problems of houses with "small" title deed(houses the title deed of which are issued by villager committee or the township government) throw out the disadvantages regarding our current land system and make it confront with theoretic and practical dilemmas and affect its justice and reason of existing.Based on our current land system,it may be our choice to limit the transference qualifications gradually and to legalize usufruct of rural residential land and finally to find out a way suitable for the development of Chinese peasants and Chinese rural economy.
