| 摘 要： | 《工伤条例》和《职工工伤保险试行办法》相比,虽然从适用范围、职工申请工伤认定时效,童工赔偿等都有利于工伤职工的规定,但也存在着一些司法现实中容易引发争议,甚至显失公平的条款。
