| 摘 要： | 对干扰婚姻关系的受害人予以精神损害赔偿不仅具有填补损害,抚慰心灵,简化赔偿程序的功能,而且具有一般预防功能。干扰婚姻关系所侵害的法益是一种身份人格利益,司法处理时需要结合个案予以处理。与一般的精神损害赔偿案件相比,干扰婚姻关系之精神损害案件的赔偿主体、构成要件及赔偿范围具有一定的特殊性。

| Abstract: | The spiritual damage compensation for the victim about interference with marital nexus is not only to fill the damage,soothes the soul,but also simplify the compensation processing,which has a general preventive function.The truth of the interference with martial nexus is an infringement of one＇s personality interests.To deal with this problem,we should focus on the specific cases in judicial processing.Comparing with the ordinary spiritual damage compensation cases,the cases about compensation for spiritual damage of interference with martial nexus have some particularity on subject of liabilities for compensation,essential elements of tort,the scope of compensation. |
