我国农村宅基地使用权变动探讨

现行的限制农村宅基地使用权变动的制度与农村宅基地使用权变动现实发生了激烈的冲突。文章从我国经济体制的变革、土地资源优化配置、农民增收渠道的拓展、城乡公平的发展权等方面阐述了农村宅基地使用权变动的必要性，从政策引导与物权法搁置性规定、户籍制度改革、社会保障体系的建立与完善、制度执行动力等方面论证了农村宅基地使用权变动的可行性，文章就农村宅基地使用权变动条件、程序等提出了若干设想。

Discussing on the Changes of Countryside Homestead Right of Use in China

The current legal system that restricts the changes of countryside homestead right of use has great and fair development right between urban and rural areas, elaborates the necessity of countryside homestead right of use. This thesis also, based on the policies and regulations of the Real Right Law, reform of domiciliary system, establishment and perfection of social security system and the system execution motive power, elaborates feasibility of changes of countryside homestead right of us. Finally this thesis puts forward some assumptions on the conditions and procedure of changes of countryside homestead right of USe.
