权力来自权利的转让

有些权利不可转让；有些权利可以转让，但转让后还是权利而不是权力；有些权利的行使可能“产生”权力，但此权力是“构建”而并非“转让”的；有些权利的行使“启动”了权力，但并没有转让权利给权力；有些权利的行使产生了权力的载体，但并未产生权力本身。因此权力不是来自权利的转让，而是来自权力的转让：有的公权力来自私权力的转让（如部分国家权力、社会权力来自私权力的转让）：有的公权力来自公权力的转让（如国家权力与国家机关权力、国家机关权力彼此之间的转让，国家权力与社会权力之间、社会权力与社会权力之间的转让）；有的私权力来自私权力的转让；有的私权力来自公权力的转让。宪法权力也不是来自宪法权利，而是来自私权力和社会权力的转让。

Are Powers Demises of Rights？

Some rights are unalienable while some in reverse. A right demised is still a right but not a power;a power, however, may derivate from some of such rights. In this case a power is more ＂derivative＂ or ＂constituted＂ than ＂demised＂. The exercise of some rights may switch on the engine of powers,but it never transfers such rights into powers ; the exercise of the others may leads to the creations of the carrier of powers but not the powers themselves. Therefore a power is not a demise of a right but a power, either a private power or a public power; similarly, a private power is a demise of either a private power or a public power. This is also true in relation to a constitutional power.
