| 摘 要： | 生产、销售有毒、有害食品罪属抽象危险犯。针对行政执法与刑事司法的衔接、有毒或有害食品的司法认定、主观上明知和客观上因果关系的证明等问题,应当进行刑法与刑事程序法、刑事证据法的一体化思考和安排。
