| 摘 要： | 实行行为的概念必须从形式和实质两方面理解。从形式上看,实行行为是我国刑法分则条文规定的行为;而在实质上实行行为必须是对法益侵害具有现实危险的行为。在我国,实行行为可以区分为普通的实行行为、组织性的实行行为、帮助性的实行行为、教唆性的实行行为以及预备性的实行行为。从机能上考察,实行行为具有犯罪化机能、犯罪个别化机能以及界限机能。
