论我国行政复议机构的法律独立性

我国行政复议机构缺乏独立性导致行政复议效果欠佳。提高行政复议主体的独立性符合行政正义的价值理念，是各国行政制度改革的基本趋势，也是WTO对成员国的基本要求。我国需要在制度上对现行行政复议机构进行改革，加强行政复议机构的独立性、公正性。为此，我国应当成立独立的行政复议委员会，配备高素质的复议人员，并实现复议审查程序的规范化。

Study on the Independence of Administrative Reconsideration Agency

Our country＇s administrative reconsideration hasn＇t got good effect due to reconsideration agency lacks independence.Improve the independence of reconsideration agency embodies the value of administrative justice,is also a basic request of WTO.It＇s necessary to reform our country＇s reconsideration system to enhance the independence of reconsideration agency.So we should establish an independent committee of administrative review which be equipped with staff who have good education, and adopt normative review procedure.
