和谐社会下监狱行刑的改革与发展——以刑事政策为视角

建设和谐社会,尽量降低重新犯罪率是必要的。在重新犯罪中,财产性的犯罪居于首位,这是因为在监狱行刑中,服刑人员的"监狱化"以及未能在劳动改造过程中掌握与社会发展相适应的职业技能,使得他们在刑满释放以后不能顺利融入社会,一部分人又重新犯罪。因此,有必要从整个和谐社会刑事政策的价值追求层面,来指导监狱行刑的改革,使犯罪人在行刑过程中,能够尽可能地与社会接近,尽量减少其"监狱化"人格,并且能够掌握其复归社会所需要的职业技能。

The Reform and Development of Prison Execution in Harmonious Society——from the View of Criminal Policy

In order to construct harmonious society,it is necessary to try to decrease the recidivism rate.Among repeated crimes,the property crimes remain the first rate because the prisoners haven't learnt vocational skills so they can't integrate into the society and some of them commit crime again.So it is necessary to guide the reform of prison execution and make the criminals communicate with society as closely as possible duing their serving sentence in order to decrease their personality of "prisonization",grasp necessary vocational skilles and finally integrate into the society from the persuing value layer of criminal policy in the harmonious society.
