| 摘 要： | 目前我国关于孤儿监护的制度安排尽管有相关法律规定，但滞后于现实需要，缺乏系统性和可操作性，导致孤儿权利缺失，发展受到制约。完善孤儿监护制度，应规范和完善孤儿监护主体，提升监护质量，确保监护资金到位，建立监督机制。

| Abstract: | The guardianship institution of orphans in China has been set in correlative laws, but lag to practical needs and lack of system and maneuverability, which induce the short of right and development restriction of orphans. To improve the guardianship institution of orphans, should standardize the wardship subject, advance the wardship quality, insure the fund and build the supervisory mechanism. |
