关于人民警察出庭作证问题的研究

警察出庭作证,接受控辩双方的质询,是当今世界上绝大多数国家立法要求警察承担的一项义务,也是司法实践的需要。然而我国立法却未规定人民警察出庭作证制度,司法实践中人民警察出庭作证也实属罕见。为进一步完善我国司法体制,构建人民警察出庭作证制度是必要的。人民警察出庭作证有其特定的理论基础和诉讼价值。在我国现行诉讼模式下构建人民警察出庭作证制度还存在着一些障碍,需要不断探索,以推动法制观念的更新和司法工作的完善。

Research on Police Testifying in Court

It’s required as a duty and needed by judicial practice in most countries for police to testify in court and accept the examination from both prosecution and defense. Whereas no system of police testifying is in China’s legislation, and police testifying in court is rare in judicial practice in China. Therefore, it is necessary to improve judicial system and set up system of police testifying. Police testifying processes specific basic theory and lawsuit value. To improve law and judicature, certain obstacles should be eliminated in China’s current lawsuit mode to construct police testifying.
