| 摘 要： | 环境侵权概念应恪守传统理论 ,其所侵犯的利益仅限于私法上的人身利益和财产利益。至于环境利益 ,可以成为环境侵害概念中所侵犯的利益对象 ,而不是环境侵权所侵犯的利益。只有这样 ,才能准确把握环境法与侵权法的各自功能和作用领域 ,从而有效维护环境侵权领域的各种利益

| Abstract: | The concept of Environment encroaching right should abide by traditional theory,the interests infringed by it are limited to personal and property interests of private law only. As for environmental interests, can become the interests targets that are infringed of the concept, but not the interests infringed by environment encroaching right. Only in this way, could hold the function environmental law and encroaching right accurately, thus safeguard various kinds of interests that the environment encroaching right in the field effectively. |
