| 摘 要： | 监视居住在当今的诉讼实践中很少适用;即使适用,也经常被操作成变相的拘禁或比取保候审还宽松。为改善监视居住的这种适用现状,应该正确理解监视居住地点、对象、对被监视居住者人权的限制,更新关于监视居住的观念,采用适当的方式执行并及时依法变更、撤销监视居住。

| Abstract: | Keeping watch on living is seldom applied to in the current lawsuit practice; even it is applied to, often operated into disguised custody or even looser than being bailed out. In order to improve such suitable current situation , the place of residence , target , restriction on human rights of the person monitored should be understand correctly, the idea should be upgraded, then proper way should be adopted, carried out and replaced accord with the law in time. |
