| 摘 要： | 不纯正不作为犯可罚性的关键在于等价性问题,基本含义是以不作为方式实现的犯罪事实在违法价值上与作为相等。由于等价性的刚性作用,又鉴于我国的研究现状,这一问题值得关注。等价性属于犯罪构成要件符合性的问题,应放在犯罪构成中客观要素的位置。

| Abstract: | The decisive factor to punish non-typical omission lies in its equal value.The basic meaning is that its delinquent account equals to action in illegal value.Because of the rigid function of equal value and,in the view of present research situation in China,this issue is worth paying attention to.Equal value belongs to conforms of constitutive elements of crimes.It should be placed in the objective essential factor of crime constitution. |
