我国权证市场存在的问题及其法律规制路径

权证作为证券衍生品,在我国资本市场发展的同时,自身的一系列现实问题也随之凸显。从法律上分析导致权证现实问题的主要成因在于,现有关于权证法律规制的效力不足和现行权证的具体自律规则不完善。因此,应在现有证券法律框架内构建我国权证市场的法律规制体系,完善权证具体的法律制度。
