美国成文法与传统大陆法系成文法立法理念比较研究

学习和借鉴欧美立法经验已经成为我国立法工作的一个基本要求和普遍现象。在理解和把握中国现代法律转型的过程中,正确地理解西方国家立法背后起支配作用的立法理念的差异,就显得尤为重要。本文从认识论、社会观和价值观三个主要方面简要分析了美国成文法与大陆法系成文法在19世纪的发展过程中体现出来的不同的立法理念,以期有助于对中国近代法律转型这个庞大主题的理解。

Comparison of Law-making Ideas of American Statute Law and Traditional Continental Galaxy Statute Law

Learning the legislative experience of Europe and America has become the basic demand and common phenomenon in our legislation. To correctly understand the leading law - making ideas of western country is of great importance in the process of understanding and mastering Chinese modern law transformation. This thesis briefly analyses the different law-making ideas of America statute law in the 19th century and continental law Galaxy from values, in order to be helpful for the understanding of grand subject of Chinese modern law transformation.
