摘    要:我国对比较广告的规定存在法律地位不高、法条过于简单、合法与违法划分不科学、缺少引导性规范和法律适用不统一等缺陷。应借鉴国外经验,采取积极的法律规制措施,对比较广告予以明确的法律指引和规范,具体可从明确其合法地位和适用范围、比较标准和条件以及行为主体相应的法律责任等方面着手。

Abstract:The legal norms regulating comparative advertisement in China are in a low level and too simple, and the separation between legality and illegality is not scientific, lacking directive criterions. Based on foreign experiences, we should take active regulating measures, giving comparative advertisement clear legal directives. Specifically speaking, we should recognize clearly its legal status and applicable scope, comparative criterion and conditions, and legal liabilities of behavioral body.
