| 摘 要： | 离婚损害赔偿制度是修改后的婚姻法确立的一项损害赔偿制度 ,它与一般民事损害赔偿制度的法理基础相同 ;离婚损害赔偿制度的确立对保护婚姻当事人的合法权益、打击婚姻家庭领域的违法犯罪行为、健全我国的婚姻家庭制度有着非常重要的现实意义 ;离婚损害赔偿制度包含损害赔偿的构成要件、损害赔偿的适用范围、损害赔偿请求权的行使等问题。

| Abstract: | Damage compensation for divorce was established in the amended law of marriage, whose jurisprudence foundation is the same as that of general civil damage compensation.Its establishment shows great realistic significance in protection of marital partners' legal rights and benefits,in cracking down on the offending actions in the field of marriage and family,and in perfection of the system about marriage and family.It includes its constitutive elements,its applying scope,and its exercise,etc. |
