| 摘 要： | 行政参与权的法律保障是指行政参与权得到法律的确认,并通过法律的实施,确保其有效行使。行政参与权的法律保障是参与式行政法律关系的稳定机制,但是现行法律制度对行政参与权的保障存在不足,需要从效力制度、责任制度、相关配套制度以及救济制度等方面进行改进与完善。

| Abstract: | Legal guarantee of the right to administrative participation refers to the determination by law,and the implementation of laws can ensure the right to administrative participation be carried out effectively.Legal guarantee of the right to administrative participation is a stabilization mechanism of participatory administration and legal relation.But the guarantee of the existing legal system for the right to administrative participation remains inadequate.Hence we should improve and perfect the effect system,liability system,related systems,relief system and some other covering systems of the existing legal system. |
