| 摘 要： | 认定交通事故责任,是处理交通事故中专业性很强的工作,其认定主体的特定性和权威性,体现在相对一方当事人没有其他选择余地的只能由公安交通管理部门,根据法律法规授权作出的一种行政行为。该责任认定行为直接关系到当事人是否构成犯罪以及承担民事赔偿责任的问题。对道路交通事故责任的认定不服,根据行政诉讼法的立法宗旨,以及行为对相对人权利和义务的影响,应当提起行政诉讼。

| Abstract: | As for the confirmation of the road traffic accident duty,if the party refuses to obey,can he charge the administrative lawsuit? This problem has been causing many disputes for a long time. Through the analysis of the source of the issue and dispute, and the regulations of current laws, and various points of views in the law circle, and the influences and results of the rights and duties of the parties, this paper improves that the charge about the confirmation of traffic accident duty is workable and practical. |
