刑事辨认证据规则初探

刑事辨认证据的认定与运用是各国司法实践中面临的相当复杂的问题。目前,我国的刑事辨认证据的运用尚处于无序、混乱的状态之中。辩认结论应当是一种独立的证据形式,应将辨认结论规定为法定证据种类之一,同时应确立非法辨认的排除规则,明确重复辨认的证据效力,确立辨认结论的补强规则等。

On Evidential Rules on Criminal Identification

The cognizance and use of criminal identification is a considerable problem in law practices of many countries.In chinese law practices the using of the evidence of criminal identification is still in out-of-order.The article discusse on the rules of criminal identification on the base of the theories and legislation in western countries,and bring forward some assumption on perfecting the the rules of criminal identification in PRC Criminal Procedural Law,for example,placing the criminal identification as a legal evidence;establishing the rule of exclusion on illegal identification;definitizing the evidential value of repeated identification;establishing the corroboration rule of criminal identification,etc.
