| 摘 要： | 民事执行检察监督历经二十余年的坎坷，在2007年民事诉讼法修订之后再度陷入困境。2010年9月。最高人民检察院通过《关于加强和改进民事行政检察工作的决定》，又提出要“明确对民事执行工作检察监督的范围和程序”。一方面得不到立法者的支持，另一方面检察院又想有所作为，那么只能在困境中反思，在反思中寻求突围的路径。民事执行检察监督最大的障碍不是法院的存心阻挠，而是检察院自身。如果不从根源上铲除障碍，制度入法的美好愿望恐怕难以实现。
