| 摘 要： | 文章从缓刑类型、缓刑适用、缓刑执行三个角度，考察了我国缓刑制度的立法现状。反思了我国现行缓刑制度所存在的不足，提出相应的立法完善之策，明确适用缓刑的实质要件，指出我国应将缓刑的考察主体变更为司法机关，对未成年人犯罪应从宽适用缓刑，法律应对缓刑负担和缓刑指示作出明确的规定。

| Abstract: | The article reviews the current legislation and insufficiency of probation institution, and puts forward the strategies to improve legislation form three angles as follow：the typical, application and implement. And the essential condition of application should be definitude. The justice organ should change to be the supervise subject of probation. The minor should apply probation forgivingly. The burden and indication of probation should be definitude in the law. |
