论法律发现及其方法

法律发现是指法官判案时生成裁判规范的活动。在实际进行法律发现的各种方法中,有古老的,有现代的;有简单的,有复杂的。不过,集中体现法官能动性和创造性的方法主要有比较适用的方法;冲突解决的方法;法律解释的方法;漏洞填充的方法;利益衡量的方法等。这些方法各有其特色,其运用皆体现了严格规则主义与自由裁量主义的有机结合。

Discovering the law is an activity that frames rules in the process of judges' adjudication.In practice,there are a variety of methods to discover the law,some of which are hoary,some are modern,some are simple and some are complex.However,those that can strikingly represent a judge's initiative and creative ability include comparative application method,conflict-resolving method,legal interpretation method,loophole-stopping-up method,interest-balancing method,etc.,each of which has merits and demerits and the application of which requires an organic coordination of rigorous canonization with discretion.
