妨害传染病防治罪立法的比较与借鉴

与其他国家(地区)的刑法相比较,我国《刑法》第330条关于妨害传染病防治罪的立法应作如下修订:第一,扩大妨害传染病防治罪中“传染病”的范围,将乙类和丙类传染病也纳入“传染病”的范畴;第二,将故意妨害传染病防治的行为规定为独立的罪名,并设置独立的法定刑;第三,取消对妨害传染病防治罪主体和行为方式的限制性规定;第四,为妨害传染病防治罪的危险结果和实害结果设置不同的法定刑。

Legislations Concerning the Offense of Impairing Prevention and Treatment of Infectious Diseases

Compared with the legislations elsewhere,Art.330 of the Criminal Act of the PRC that relates to the offense of impairing prevention and treatment of infectious diseases looks a little bit inappropriate and it needs to be amended as follows.Firstly,the range of "infectious diseases" should be extended so as to include B Class and C Class infectious diseases.Secondly,deliberately impairing prevention and treatment of infectious diseases should be defined as a separate offense and statutory penalties should be imposed.Thirdly,restrictive provisions for perpetrators of this offense and their behaviors should be abolished.Fourthly,different penalties should be imposed for potential harms and actual consequences done and entailed by impairing prevention and treatment of infectious diseases.
