构建和谐社会与当代中国检察官的职业定位

本文从政治学、社会学的视角对检察官的职业定位问题进行了剖析.认为:必须紧紧抓住中国政治权力构架下中国检察权这一权力设置的独特性,即其核心和本质是法律监督权;必须将检察官职业定位于职业法律守护人,即护法官;在此前提下,对于检察官职业进行科学客观的角色定位,在改进执法理念等层面上作出努力,以实现建设法治国家和和谐社会所要求的职业目标.

Professional Orientation of Chinese Public Prosecutors in Building a Harmonious Society

This article analyses professional orientation of public prosecutors irom the perspective of politics and sociology and holds that we should, in the framework of Chinese political power, hold on to this exclusive prosecutorial power, the core and essence being legal supervisory power. Only under the premise that public prosecutors should be oriented as guards defending law, or law-protecting officers could we give a scientific and objective definition of prosecution as a profession. Public prosecutors should also endeavor to have better understanding of law enforcement so as to achieve the professional target required of them in building a rule-of-law country and a harmonious society.
