从发展中国家视角看全球化时代知识产权的国际保护问题

知识产权制度自身的合理性是存在着可争辩性的,而其在现实中的运行实践更是表明这一制度已经异化为少数发达国家攫取利益的工具.在当今这样一个资本全球统治的时代,任何一个国家制定的规则都会以考虑本国利益以及与其有同样利益的国家为主,因此在对待知识产权制度问题上,特别是在知识产权国际保护问题上,发展中国家尤其需要持一种谨慎的态度,而不能一味迎合发达国家的需求,否则就不可避免地要牺牲掉发展中国家知识产权法律应有的独立品格.

Reflection on the Problem of International Protection of the Intellectual Property in the Era of Globalization: From the Perspective of Developing Countries

The problem of international protection of the intellectual property is an important one in the era of Globalization.This paper probes into the precondition of the problem,namely,the rationality of the system of intellectual property and analyses it in the background of globalization.In fact the rationality of the system of intellectual property is debatable and the system has been alienated as a tool by the developed countries.So in today's era in which capital governs globe,the developing countries should take a prudent attitude towards the problem of international protection of the intellectual property.The developing countries can't cater to the needs of the developed countries or they will fall victim to it.
